Shipments from the United States to Mexico
These Terms and Conditions (hereinafter, “Terms”) govern the use of the parcel service offered by Tornado Bus Company (hereinafter, “the Company,” “we,” or “Tornado”) for the transportation of packages from the United States of America to the United Mexican States. By using this service, the customer (hereinafter, “the Sender” or “you”) fully accepts these Terms.
- Description of Service
Tornado offers package transportation for individuals or legal entities from its terminals or authorized collection points in the United States to destinations in Mexico, using its network of buses and delivery points. The service is ground freight transport and does not include express courier services with guaranteed times. Unless a special service is expressly contracted, all shipments are final, and the package cannot be returned to the country of origin or point of origin. - Acceptance of Shipment
The Sender declares to be the legitimate owner of the package or duly authorized to send it.
The Company reserves the right to reject any package that does not comply with these Terms, contains prohibited items, or presents security, hygiene, or legal risks.
Upon handing over the package, the Sender agrees that Tornado may inspect it (including via X-ray or opening) for security and regulatory compliance reasons. - Prohibited Items
The shipment of the following is strictly prohibited:
Firearms, ammunition, explosives, flammable, or hazardous substances.
Drugs, narcotics, or controlled substances.
Cash, bearer checks, high-value jewelry, precious metals, or negotiable documents without prior written authorization.
Live animals, human remains, biological, or perishable material without special authorization.
Items illegal in the United States or Mexico, or that violate customs regulations.
Any other item determined by the Company to be risky or prohibited.
Note: Shipping prohibited items may result in retention, destruction, or handover to authorities without entitlement to a refund, and the Sender will assume all civil and criminal liability. - Packaging and Labeling
The Sender is solely responsible for properly packaging the contents to withstand normal transport.
The package must be open at the time of drop-off at Tornado terminals for a visual inspection by Tornado staff; once the inspection is complete, the package must be sealed in front of the sender.
Tornado is not responsible for damages resulting from poor packaging. - Documentation and Customs
The Sender is responsible for providing all necessary documentation (commercial invoice, packing list, customs declarations, etc.).
The recipient or Sender (as applicable) will be responsible for paying taxes, duties, VAT, and any other levies determined by Mexican customs authorities.
Tornado acts solely as a carrier and not as a customs broker. Any delays, detentions, or seizures by customs are the exclusive responsibility of the Sender/Recipient. - Delivery Times
Transit times are estimated and not guaranteed. They may be affected by weather conditions, security checks, border congestion, mechanical failures, strikes, acts of authority, or force majeure. Tornado does not guarantee exact delivery dates. - Limitation of Liability
Tornado’s maximum liability for loss, damage, or misplacement of a package is limited to the value declared by the Sender at the time of shipment, up to a maximum cap determined by the Company in its current rate schedule (consult terminal or website).
If no value is declared, liability is limited to the minimum amount established by the Company ($100.00 USD), with no right to a refund for handling and shipping.
Tornado is not liable for indirect damages, lost profits, delays, or consequential losses.
Purchasing additional insurance is recommended for high-value shipments. - Claims
Any claim for loss or damage must be submitted at the time of receiving the package—whether through home delivery or hold-for-pickup service (“ocurre”)—with the carrier company responsible for delivering the package.
Proof of shipment, a description of the contents, value, and evidence of damage or loss are required.
Claims submitted after the deadline will be rejected. - Rates and Payments
Rates are calculated based on weight, dimensions, origin, destination, and service type according to Tornado’s current rate schedule.
Payment is made at the time of package drop-off at the point of origin, unless special agreements exist.
Rates do not include customs taxes or duties.
If the package is returned to the collection point because the beneficiary failed to pick up/receive the package at the time of delivery, the sender must cover handling and reshipment costs again on the Mexican side or in the destination country. - Personal Data
By using the service, the Sender authorizes Tornado to collect, use, and share personal data necessary for providing the service (including with customs and security authorities). Data processing is conducted in compliance with applicable personal data protection legislation. - Modifications
Tornado reserves the right to modify these Terms at any time. Updated versions will be posted at sales points and/or on the Company’s official website. Continued use of the service implies acceptance of the modifications. - Applicable Law and Jurisdiction
These Terms are governed by the laws of the United States of America and, where applicable, by the laws of the United Mexican States regarding transportation and customs. Any dispute will be submitted to the competent courts of the place where the service originated or as determined by the Company. - Contact
